Background: Managing HIV treatment is a complex multi-dimensional task because of a combination of factors such as stigma and discrimination of some populations who frequently get infected with HIV. In addition, patient-provider encounters have become increasingly multicultural, making effective communication and provision of ethically sound care a challenge. Purpose: This article explores ethical issues that health service providers in the United States and Botswana encountered in their interaction with patients in HIV care. Research design: A descriptive qualitative design was used (...) to collect data from health service providers and patients using focused group discussions. This article is based on responses from health service providers only. Participants and context: This article is based on 11 focused group discussions with a total sample of 71 service providers in seven US sites and one Botswana site. Ethical considerations: Ethical review boards at all the study sites reviewed the study protocol and approved it. Ethical review boards of the study’s coordinating centers, Rutgers University and the University of California at San Francisco, also approved it. The study participants provided a written informed consent to participate. Findings: HIV service providers encountered ethical challenges in all the four Beauchamp and Childress’ biomedical ethics of respect for patients’ autonomy, beneficence, justice, and nonmaleficence. Discussion: The finding that HIV service providers encounter ethical challenges in their interaction with patients is supported by prior studies. The ethical challenges are particularly prominent in multicultural care and resource-constrained care environments. Conclusion: Provision of HIV care is fraught with ethical challenges that tend to pose different issues depending on a given care environment. It is important that strong partnerships are developed among key stakeholders in HIV care. In addition, health service providers need to be provided with resources so they can provide quality and ethically sound care. (shrink)

As scientific and engineering efforts become increasingly global in nature, the need to understand differences in perceptions of research ethics issues across countries and cultures is imperative. However, investigations into the connection between nationality and ethical decision-making in the sciences have largely generated mixed results. In Study 1 of this paper, a measure of biases and compensatory strategies that could influence ethical decisions was administered. Results from this study indicated that graduate students from the United States and international graduate students (...) studying in the US are prone to different biases. Based on these findings, recommendations are made for developing ethics education interventions to target these decision-making biases. In Study 2, we employed an ethics training intervention based on ethical sensemaking and used a well-established measure of ethical decision-making that more fully captures the content of ethical judgment. Similar to Study 1, the results obtained in this study suggest differences do exist between graduate students from the US and international graduate students in ethical decision-making prior to taking the research ethics training. However, similar effects were observed for both groups following the completion of the ethics training intervention. (shrink)

In the past decade, numerous ethical frameworks have been developed to support public health decision‐making in challenging areas. Before the COVID‐19 pandemic began, members of the authorship team were involved in research programmes, in which the development of ethical frameworks was planned, to guide (a) the use of new technologies for emerging infectious disease surveillance; and (b) the allocation of scarce supplies of pandemic influenza vaccine. However, as the pandemic evolved, significant practical challenges emerged that led to our questioning the (...) value of these frameworks. We now believe that a normative instrument, such as a framework, cannot adequately or reliably provide the ethical guidance that needs to be incorporated into public health decision‐making during natural disasters or infectious disease emergencies. Recently it has been suggested that there are potentially more dynamic, flexible, and effective ways to navigate decisions involving complex considerations entailed in policies and practices during a public health emergency. In this paper, we first outline the key functions of a public health ethics framework, before describing why we believe it would not be fit for purpose during a crisis. We end by considering whether proposed alternative methods to promote ethical public health decision‐making goals have the potential to meet these objectives. (shrink)

Is 50 considered “old”? When do we stop being considered “young”? If individuals could choose to be any age, what would it be? In a sample of 502,548 internet respondents ranging in age from 10 to 89, we examined age differences in aging perceptions (e.g., how old do you feel?) and estimates of the timing of developmental transitions (e.g., when does someone become an older adult?). We found that older adults reported older perceptions of aging (e.g., choosing to be older, (...) feeling older, being perceived as older), but that these perceptions were increasingly younger than their current age. The age to which individuals hope to live dramatically increased after age 40. We also found that older adults placed the age at which developmental transitions occurred later in the life course. This latter effect was stronger for transitions involving middle-age and older adulthood compared to transitions involving young adulthood. The current study constitutes the largest study to date of age differences in age perceptions and developmental timing estimates and yielded novel insights into how the aging process may affect judgments about the self and others. Résumé Cet article soutient que la causalité au sens humien (mettant en relief la succession) qui fut la principale cible des critiques du Réalisme Critique de Bhaskar, demeure très présente dans le concept même de “mécanisme”. En effet, le concept de mécanisme implique une abstraction newtonienne du temps ignorée par le Réalisme Critique. Il s’agit cependant d’un problème plus large d’abstraction mécaniste, que cet article analyse simultanément sous l’angle du Réalisme Critique et de la discipline ayant pour objet l’étude des (...) mécanismes, la cybernétique. Comment des descriptions de mécanismes causals peuvent-elles se réconcilier avec leurs propres abstractions? En réponse nous proposons une dissolution du problème du temps au travers de l’expérience vécue. Par ailleurs, nous traitons également des questions liées à la pédagogie de l’enseignement des abstractions, à la mise au point de nouveaux contextes d’interaction et au rôle des technologies dans la mise en place des contextes ludiques. Enfin, nous dégageons des implications plus profondes pour la recherche réaliste, et soulignons la nécessité de traiter conjointement les problèmes d’abstraction et les problèmes pédagogiques et technologiques. The rule of law is a necessary condition for any substantive theory of justice. If a theory sacrifices the rule of law, justice, too, is sacrificed. The connection between the necessary condition and justice is explored in the work of John Rawls, H. L. A. Hart, Karl Marx, Emile Durkheim, Albert Camus and William Shakespeare. The conceptions of justice elaborated in each of these political thinker's works share very little more than the rule of law. Since the conceptions examined (...) are so different and the necessary condition is contained in each, I conclude that there is substantial support for the thesis. ;In order to do justice to the texts examined in this dissertation the plain language, the words on the page, must be given priority but cannot be fully determinative of the text's meaning. The immanent structure of the text, the rules of the text which give it shape and form, must also be discerned. There are no particular rules for interpretation in general, yet each text contains within it its own individual rules. The rules of the text are what allow the meanings of the text to play themselves out for different readers. Understanding the history of the text is also important for interpretation. ;Some interpretations of the theories of justice examined here have sought to change the substance of that theory through interpretation. For example, Marx's theory depends upon the law of equal commodity exchange. As shown in chapter three, if an alien supposition of distributive justice is interpreted into Marx's theory so that the surplus value which Marx claims belongs to the capitalist is redistributed, then the proposed transition to communism, which Marx analyzed and supported, will not occur. Doing justice to Marx's texts allows Marx's theory of justice to come through and be judged on its own terms. Only after that has been accomplished can it be evaluated and compared with other theories. The same association between interpretative method and substantive meaning is demonstrated for each theory. The conclusion compares interpretation in law and drama and connects doing justice to texts with justice. (shrink)

Revealing Male Bodies is the first scholarly collection to directly confront male lived experience. There has been an explosion of work in men's studies, masculinity issues, and male sexuality, in addition to a growing literature exploring female embodiment. The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

But if God could not do otherwise than create the best world, he created the world of necessity, not freely, (...) and we have no reason to be thankful to God for creating us, since he couldn't do otherwise. Isaac Newton's Scientific Method examines Newton's argument for universal gravity and his application of it to resolve the problem of deciding between geocentric and heliocentric world systems by measuring masses of the sun and planets. William L. Harper suggests that Newton's inferences from phenomena realize an ideal of empirical success that is richer than prediction. Any theory that can achieve this rich sort of empirical success must not only be able to predict the phenomena it purports to explain, but (...) also have those phenomena accurately measure the parameters which explain them. Harper explores the ways in which Newton's method aims to turn theoretical questions into ones which can be answered empirically by measurement from phenomena, and to establish that propositions inferred from phenomena are provisionally accepted as guides to further research. This methodology, guided by its rich ideal of empirical success, supports a conception of scientific progress that does not require construing it as progress toward Laplace's ideal limit of a final theory of everything, and is not threatened by the classic argument against convergent realism. Newton's method endorses the radical theoretical transformation from his theory to Einstein's.
